Agreement to Terms

By downloading, installing, or using Ember Notes ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is developed and operated by Delightful Apps ("we," "us," or "our").

Use of the App

Ember Notes is a personal notes and prompt management application for iOS and macOS. You may use it for any lawful purpose. You agree not to:

• Reverse-engineer, decompile, or disassemble any part of the App
• Use the App to store or transmit content that violates applicable laws
• Attempt to circumvent any security or licensing mechanisms
• Redistribute or resell the App or any part of it

Your Content

You retain full ownership of all notes, prompts, and other content you create in Ember Notes. Your content is stored locally on your device and synced through your personal iCloud account. We do not access, read, or claim any rights to your content.

Subscriptions & Payments

Ember Notes offers a free tier and an optional Pro subscription. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and policies. You can manage or cancel your subscription at any time through your device's Settings → Subscriptions.

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• Free trial periods, if offered, are forfeited upon purchasing a subscription

Third-Party AI Services (BYOK)

Ember Notes supports optional integration with third-party AI providers through a Bring Your Own Key model. When you use these features, your content is sent to the respective provider and is subject to their terms and privacy policies. We are not responsible for how third-party providers handle your data.

Intellectual Property

The App, including its design, code, graphics, logo, and brand name "Ember Notes," are the intellectual property of Delightful Apps and are protected by applicable copyright and trademark laws. These Terms do not grant you any rights to use our branding or trademarks.

Disclaimer of Warranties

Ember Notes is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, Delightful Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the revised Terms.
